Flying in Philly

You have an upcoming project in Philly and you're wondering if we can capture it on film for you. The answer is yes.


The city of Philadelphia, actually any city or town in PA, cannot set laws to govern sUAS activity. The FAA oversee all flight operations. To fly a drone as a commercial enterprise we are required to follow the requirements of the FAA’s Part 107 Small UAS Rules.


A Pennsylvania law, enacted on October 12, 2018, Title 53 Sec. 305 states that no Pennsylvania county, city, borough, incorporated township, or municipality is allowed to regulate the ownership or operation of unmanned aircraft. All municipal rules are preempted by Pennsylvania state code Title 18 Sec. 305 and by the FAA’s rules for flying a drone.


The city of Philadelphia will on occasion declare an outdoor event as a temporary "No Drone Zone" to protect the public (recreational pilots cannot fly in this area during event hours). Such an event would require THE FLYING LIZARD to fly under FAA's Part 107 rules, obtain an approved FAA Waiver, and notified the City through the Philadelphia UAS Notification Form. All relatively easy for us to manage. Please allow 3 - 4 weeks in case the city reaches out to us with questions or concerns.
